NASHVILLE TOUR
LIABILITY WAIVER, ASSUMPTION OF RISK, TERMS & CONDITIONS
Effective Date: June 16, 2026
By purchasing a ticket, participating in a tour, or accompanying a tour group operated by Nashville Tour (“Company”), the participant (“Participant”) agrees to the following terms:
1. ASSUMPTION OF RISK
Participant understands that participation in a walking tour involves inherent risks, including but not limited to:
- Uneven sidewalks and pavement
- Curbs, stairs, ramps, and elevation changes
- Vehicular traffic
- Bicycle and scooter traffic
- Construction zones
- Weather conditions including heat, humidity, rain, lightning, wind, and cold temperatures
- Crowded public spaces
- Physical exertion associated with walking and standing for extended periods
- Acts or omissions of third parties
Participant voluntarily assumes all risks associated with participation in the tour, whether known or unknown.
2. RELEASE OF LIABILITY
To the fullest extent permitted by law, Participant releases and discharges Nashville Tour, its owners, officers, employees, contractors, volunteers, guides, affiliates, successors, assigns, and business partners from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising from participation in the tour, including personal injury, illness, death, property damage, or property loss.
This release applies to claims arising from ordinary negligence but does not apply where prohibited by applicable law.
3. MEDICAL FITNESS
Participant represents that they are physically capable of safely participating in the tour.
Participant acknowledges that tours may involve walking distances of one to three miles, prolonged standing, and exposure to outdoor conditions.
Participant agrees to assume responsibility for any medical condition that may affect their participation.
4. EMERGENCY MEDICAL TREATMENT
In the event of an emergency, Participant authorizes Nashville Tour and its representatives to obtain medical treatment deemed reasonably necessary.
Participant accepts full responsibility for any resulting medical expenses.
5. PARTICIPANT RESPONSIBILITIES
Participant agrees to:
- Follow all instructions provided by the guide.
- Obey all local, state, and federal laws.
- Exercise reasonable care while crossing streets and navigating public spaces.
- Remain with the tour group unless otherwise directed.
- Treat fellow participants, guides, and members of the public respectfully.
Nashville Tour reserves the right to remove any participant whose behavior is disruptive, dangerous, intoxicated, threatening, or unlawful. Removal shall not entitle the participant to a refund.
6. PHOTO AND VIDEO RELEASE
Participant grants Nashville Tour the unrestricted right to photograph, video record, and otherwise capture their likeness during the tour.
Participant grants Nashville Tour a perpetual, royalty-free license to use such images, recordings, and likenesses for promotional, advertising, educational, website, social media, and marketing purposes without compensation or further approval.
7. HISTORICAL CONTENT DISCLAIMER
Nashville Tour presents historical information for educational and entertainment purposes.
Participant acknowledges that historical interpretations may vary and that tour commentary may include folklore, legend, disputed accounts, theatrical presentation, and differing scholarly viewpoints.
No representation is made that every statement presented reflects a universally accepted historical interpretation.
8. INDEPENDENT CONTRACTOR STATUS
Nashville Tour operates independently.
Participation in a Nashville Tour does not create any relationship between the participant and any venue, property owner, museum, theater, restaurant, hotel, sponsor, affiliate, or partner featured or visited during the tour.
Any such entities are expressly released from liability arising from participation in the tour unless otherwise required by law.
9. INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless Nashville Tour and its representatives from any claims, damages, losses, liabilities, costs, and attorneys’ fees arising from Participant’s conduct, negligence, unlawful acts, or violation of these terms.
10. WEATHER AND FORCE MAJEURE
Nashville Tour reserves the right to modify, postpone, reroute, shorten, or cancel any tour due to weather conditions, public safety concerns, government orders, emergencies, civil disturbances, acts of God, or circumstances beyond its reasonable control.
In such circumstances, Nashville Tour may offer rescheduling, credit, or refund at its sole discretion.
11. REFUND POLICY
Tours cancelled by Nashville Tour may be eligible for rescheduling, credit, or refund.
Participant cancellations made more than 24 hours prior to the scheduled tour may receive a refund or rescheduling option.
No-shows and cancellations made within 24 hours of the scheduled tour are generally non-refundable.
12. GOVERNING LAW
This Agreement shall be governed by and construed under the laws of the State of Tennessee.
Any dispute arising from participation in a Nashville Tour shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee.
13. SEVERABILITY
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
14. ACKNOWLEDGMENT
BY PURCHASING A TICKET, CHECKING THE ACCEPTANCE BOX DURING ONLINE BOOKING, OR PARTICIPATING IN THE TOUR, PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE LEGALLY BOUND BY IT.
Participant further acknowledges that they are waiving certain legal rights, including the right to bring certain claims against Nashville Tour and its representatives.
